TERMS OF SERVICE
Last updated: August 2026
1. OVERVIEW
Welcome to AVEMQRO.
These Terms of Service (“Terms”) govern your access to and use of the AVEMQRO website, online store, products and related services (collectively, the “Services”).
Throughout these Terms, the terms “we”, “us” and “our” refer to AVEMQRO, operated by Giovanni Perrone in Switzerland.
Our online store is powered by Shopify. By accessing or using our Services or placing an order through our store, you agree to these Terms and to the policies made available on our website, including our Privacy Policy, Refund & Return Policy and Shipping Policy.
If you do not agree with these Terms, you should not use our Services.
Nothing in these Terms limits or excludes any consumer rights that cannot legally be waived, restricted or excluded under applicable law.
2. ELIGIBILITY AND CUSTOMER INFORMATION
By using our Services, you confirm that you have reached the age of majority in your country or region of residence, or that you have the permission of a parent or legal guardian where required by applicable law.
When placing an order or creating an account, you agree to provide accurate, complete and current information.
You are responsible for maintaining the confidentiality of your account credentials and for activities carried out through your account, except where applicable law provides otherwise.
You must promptly update information where necessary to ensure that we can process your order and communicate with you.
3. PRODUCTS
We make reasonable efforts to ensure that product descriptions, photographs, specifications, dimensions and other information displayed on our website are accurate.
However, colours and appearance may vary slightly depending on your screen or device, and reasonable variations may occur between manufacturing batches.
Product photographs may be illustrative. Any differences will not affect your statutory rights where a product does not conform to the contract, description or applicable legal requirements.
We may modify or discontinue products, descriptions, prices or availability at any time, subject to applicable law and without affecting rights relating to orders already concluded.
4. ORDERS AND CONTRACT FORMATION
By submitting an order, you make an offer to purchase the products contained in your order.
Receipt of an automated order confirmation does not necessarily constitute acceptance of the order where applicable law permits otherwise.
A contract is concluded when we accept your order in accordance with the information and confirmation provided through our store, subject to applicable mandatory law.
We reserve the right to reject or cancel an order where reasonably justified, including in cases of:
- suspected fraud or unauthorised transactions;
- payment failure;
- obvious pricing or technical errors;
- product unavailability;
- incorrect or incomplete customer information; or
- circumstances preventing lawful fulfilment of the order.
If we cancel an order after payment has been received, we will refund the relevant amount using the original payment method unless another method is agreed or required by law.
Customers are responsible for checking their order details, including products, quantities, variants and delivery information, before submitting the order.
5. PRICES AND PAYMENT
Prices are displayed in the currency indicated on our website or at checkout.
The final amount payable, including any applicable shipping charges and taxes collected by us, will be displayed during checkout before the order is submitted.
Prices, products and promotions may change without prior notice. Changes will not affect orders for which a contract has already been concluded, except where permitted or required by applicable law.
In the event of an obvious pricing, typographical or technical error, we may correct the error and, where legally permitted, cancel the affected order. If payment has already been collected for an order that is cancelled, the relevant amount will be refunded.
You agree to provide valid, current and accurate billing and payment information.
Payment processing may be carried out by third-party payment service providers and may be subject to their applicable terms and security procedures.
6. SHIPPING AND DELIVERY
We ship to the destinations made available through our store and displayed during checkout.
Shipping options, costs and estimated delivery times applicable to an order will be displayed or communicated through our website or checkout where appropriate.
Where indicated, standard shipping may be offered free of charge.
Estimated standard transit time is generally 5–15 business days, unless a different estimate is displayed for the relevant product, destination or order.
Additional processing time may apply before an order is handed over to the carrier.
Delivery times are estimates unless expressly stated otherwise or unless applicable law provides mandatory delivery requirements.
Delays may occur because of carriers, customs procedures, public holidays, high order volumes, weather conditions, transportation disruptions or other circumstances outside our reasonable control.
Where tracking is available, tracking information may be provided after shipment.
Products may be shipped directly by third-party suppliers, fulfilment partners or logistics providers. Products included in the same order may therefore occasionally be delivered in separate packages and at different times.
Packaging may vary depending on the product, supplier, fulfilment location, carrier and destination.
Customers are responsible for providing a complete and accurate delivery address.
Where permitted by applicable law, additional costs caused by incorrect or incomplete delivery information supplied by the customer may be charged to the customer.
For further information, please review our Shipping Policy.
7. CUSTOMS, TAXES, DUTIES AND IMPORT CHARGES
International shipments may be subject to customs procedures, import VAT, duties, taxes or other charges depending on the destination and applicable law.
Any amounts collected by us will be indicated where applicable during checkout.
Where taxes, customs duties or import charges are not included in the price or collected at checkout, additional amounts may be payable by the recipient to the relevant carrier, customs authority or governmental authority.
We do not independently determine or control charges imposed by customs or governmental authorities.
Nothing in this section limits any obligation we may have under applicable law to disclose or collect taxes, duties or other mandatory charges.
8. RETURNS, WITHDRAWALS, REFUNDS AND CANCELLATIONS
Returns, statutory withdrawals, refunds and cancellations are governed by our separate Refund & Return Policy, which forms part of these Terms.
Customers should review that policy before completing a purchase.
Nothing in these Terms or our Refund & Return Policy limits any mandatory consumer rights that cannot legally be excluded or restricted.
9. DAMAGED, DEFECTIVE, INCORRECT OR NON-CONFORMING PRODUCTS
Please inspect your order as soon as reasonably possible after delivery.
If you receive a product that is damaged, defective, incorrect, incomplete or materially different from what you ordered or what was advertised, please contact us as soon as reasonably possible at support@avemqro.com.
We may request your order number, photographs, videos, packaging information or other reasonable evidence necessary to assess the issue.
Where a claim is valid, we will provide the remedy required by applicable law. Depending on the circumstances, this may include repair, replacement, price reduction, refund or another appropriate remedy.
Nothing in this section limits statutory rights relating to defective or non-conforming goods.
10. FAILED OR REFUSED DELIVERY
Customers are responsible for providing accurate delivery information and, where reasonably necessary, ensuring that delivery can be completed.
If delivery cannot be completed because of incorrect or incomplete information supplied by the customer, unjustified refusal of delivery, or failure to collect a parcel, additional reasonable costs may be charged where permitted by applicable law.
This section does not apply where the failure of delivery is attributable to us, our fulfilment partners or the carrier in circumstances for which we remain legally responsible.
11. THIRD-PARTY SUPPLIERS, FULFILMENT AND SERVICES
We may use third-party suppliers, fulfilment providers, logistics providers, carriers, payment processors and other service providers to operate our store and process and deliver orders.
Products may therefore be stored, processed or shipped by third parties and from locations different from our business address.
Our use of third-party providers does not remove or reduce any responsibility AVEMQRO has toward customers under applicable mandatory consumer law.
External websites or third-party services accessed through links on our website may be governed by their own terms, privacy policies and practices. We are not responsible for third-party websites or services except to the extent required by applicable law.
12. INTELLECTUAL PROPERTY
Unless otherwise indicated, the AVEMQRO name, branding, original website design, original text, graphics and other original content made available through our Services are owned by or licensed to AVEMQRO and are protected by applicable intellectual-property laws.
Third-party trademarks, product names, photographs, images and other intellectual property remain the property of their respective owners.
You may not reproduce, distribute, modify, sell, license or commercially exploit our protected original content without prior authorisation, except where permitted by applicable law.
13. PROHIBITED USES
You may not use our website or Services:
- for unlawful, fraudulent or abusive purposes;
- to violate applicable laws or regulations;
- to infringe intellectual-property or other legal rights;
- to transmit malicious code, malware or harmful technologies;
- to interfere with the security or proper operation of our Services;
- to obtain or misuse personal information unlawfully;
- to impersonate another person;
- to engage in payment fraud or unauthorised transactions; or
- to attempt unauthorised access to our systems or those of third parties.
We may restrict or terminate access to our Services where reasonably necessary in response to unlawful, fraudulent or prohibited activity, subject to applicable law.
14. ACCURACY OF WEBSITE INFORMATION
We make reasonable efforts to keep information on our website accurate and current.
Occasional typographical errors, technical errors, inaccuracies or omissions may nevertheless occur regarding product descriptions, pricing, promotions, availability, delivery information or other content.
We may correct errors, inaccuracies or omissions and update information where necessary, subject to applicable law and without improperly affecting rights arising from contracts already concluded.
15. WARRANTIES AND LIABILITY
Nothing in these Terms excludes, restricts or limits any warranty, liability or consumer right where such exclusion, restriction or limitation is prohibited by applicable law.
To the maximum extent permitted by applicable law, AVEMQRO will not be liable for indirect or consequential losses that were not reasonably foreseeable at the time the relevant contract was concluded.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury where liability cannot legally be excluded, or any other liability that cannot legally be excluded or restricted.
Products remain subject to any mandatory statutory guarantees or conformity rights applicable to the customer.
16. FORCE MAJEURE
To the extent permitted by applicable law, we will not be responsible for delays or failures caused by circumstances outside our reasonable control.
Such circumstances may include natural disasters, severe weather, transportation disruptions, customs delays, strikes, governmental actions, telecommunications or infrastructure failures, epidemics, emergencies or comparable events beyond our reasonable control.
This section does not limit rights or remedies that consumers are entitled to under mandatory applicable law.
17. PRIVACY AND PERSONAL INFORMATION
Personal information collected through our Services is processed in accordance with our Privacy Policy.
Our store is powered by Shopify, and personal information may also be processed by Shopify and other service providers where necessary to operate our store, process payments, prevent fraud, provide customer support and fulfil orders.
Please review our Privacy Policy for further information about how personal information is collected, used and protected.
18. SHOPIFY
Our online store is powered by Shopify, which provides the e-commerce infrastructure that enables us to offer our Services.
Unless expressly stated otherwise, purchases made through AVEMQRO are transactions between the customer and AVEMQRO. Shopify provides technology and related services supporting the operation of the store and is not the seller of AVEMQRO products.
19. CHANGES TO THESE TERMS
We may update these Terms from time to time, including to reflect changes to our Services, business practices or applicable legal requirements.
The current version will be published on our website together with the date on which it was last updated.
Where required by applicable law, we will provide appropriate notice of material changes.
Changes to these Terms will not improperly remove or restrict rights already acquired in relation to orders concluded before the updated Terms became effective.
20. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or enforced to the maximum extent permitted by applicable law.
The remaining provisions will continue to apply to the extent legally possible.
21. GOVERNING LAW AND CONSUMER RIGHTS
These Terms are governed by the laws of Switzerland, subject to mandatory consumer-protection laws that may apply to customers in their country of habitual residence.
If you are a consumer residing in the European Union, European Economic Area or another jurisdiction providing mandatory consumer protections, the choice of Swiss law does not deprive you of protections that cannot legally be waived under the law that would otherwise apply to you.
Nothing in these Terms limits any mandatory rights relating to consumer jurisdiction or access to competent courts.
Any dispute will be submitted to the courts having jurisdiction under applicable law.
22. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund & Return Policy, Shipping Policy and any other policies expressly incorporated into them, constitute the agreement governing the use of our Services and purchases made through our store.
If any provision of another policy conflicts with mandatory applicable law, mandatory law will prevail.
